Quick answer: Lock the file before you do anything else, using the camera's protect button, or by pulling the card, or by pulling the fuse. Copy the original file off the card and leave that copy untouched. Hand over a duplicate, never your only version. The timestamp and, on GPS cameras, the speed and coordinates written with the original are usually the part that settles the argument.

The footage you need is already being written over. That is the part most drivers do not know, and it is the reason I end up explaining the same thing at the counter every few weeks to someone holding a dash cam, a memory card and a story about an intersection.

A dash cam is a loop recorder. It fills the card, then it goes back to the beginning and records over the oldest clips. On a 32GB card in a dual channel camera at 1440p, that loop can run out in well under two hours. The camera has no idea the last ninety seconds were the most important ninety seconds of your year. It just keeps writing, because that is the whole job.

So the first hour matters more than anything else on this page. If the file survives the first hour, everything after that is recoverable, fixable, or at worst annoying. If it does not, there is often nothing left to work with. The first hour is the whole game

Almost every dash cam sold in Australia has some way of protecting the current file. The button is usually marked with a padlock, an exclamation mark, or the letters SOS, and on cameras without a screen it is often the only physical button on the body. Pressing it flags the clip you are recording so loop recording will skip over it instead of overwriting it. Some cameras move it to a separate folder called RO, EVENT or LOCKED. Same idea either way.

Most G-sensors will trigger that lock automatically on a decent impact. Most. I would not bet a claim on a sensitivity setting I have never checked, and neither should you, because a low speed nudge in a car park frequently does not register at all. Press the button yourself.

Here is the order I give people. It assumes you are safe, the vehicle is out of traffic, and nobody needs an ambulance. If anyone is hurt, that comes first and the footage waits.

  1. Make the scene safe. Hazard lights on, and get yourself and anyone else out of the traffic lane before you think about the camera at all.
  2. Press the protect button. One press, hold for a second on some models, and listen for the beep or watch for the padlock icon. This takes less time than reading this sentence.
  3. If there is no button, cut the power. Unplug the camera at the cigarette socket, or on a hardwired install pull the relevant fuse. A camera that is not powered cannot overwrite anything. Be aware that a hardwired camera in parking mode will keep recording after you switch the ignition off, which is exactly the behaviour you want on a hit and run and exactly the behaviour that will overwrite your crash clip if you leave it running for two days.
  4. Or take the card out. Eject it properly if the camera lets you, put it in your wallet, and do not put it back in the camera. This is the bluntest option and the most certain one.
  5. Now exchange details. Names, licence numbers, registration, insurer, phone number. The camera is thirty seconds of work and it is the only part of this list that expires.
  6. Photograph the scene with your phone. Wide shots showing both vehicles and the road layout, then close shots of the damage and both number plates. Phone photos carry their own time and location data, which is useful corroboration for the video.
  7. Write down the basics while they are fresh. Date, clock time, street names, direction of travel, weather, lane you were in. Ten minutes later you will be less sure than you think.
  8. Get the file off the card that night. Not next week. Card reader, laptop, copy the folder, done.

NSW has its own rules on when a crash has to go to police at all, and that is worth knowing before you get to the footage question. Service NSW sets out when a minor traffic crash can be reported online and when you need to call 000 instead. Read that rather than take my word for it, because the answer depends on injuries, towing and whether the other driver stayed.

The mistake that destroys more dash cam files than crashes do

I want to be blunt about this one, because it is the single most common thing I see and it is completely avoidable.

Do not film the dash cam screen with your phone.

People do it constantly. The camera has a two inch screen, the clip plays back on it, and holding a phone up to it feels like capturing the evidence. What you actually end up with is a wobbly, glare streaked recording of a low resolution playback, at a fraction of the original detail, with a reflection of your own hand across the number plate you were trying to capture. Every piece of data the camera wrote is gone. The date field, the GPS track, the speed log, the file structure. All of it. You have a video of a video.

The same damage happens in quieter ways. Sending the clip through WhatsApp or Messenger recompresses it hard and strips metadata to save bandwidth. Uploading to Facebook or Instagram and sending someone the link is worse again, because now the version in circulation has been through a social platform's encoder and cropped to fit a feed. AirDrop and a plain email attachment are generally kinder, but the only thing I would call safe is a straight file copy from the card.

What the original file actually carries

A dash cam clip is not just pictures. Most cameras burn a date and time stamp into the image itself, which is the visible part. Underneath that, depending on the model, the camera writes a set of data either into the video container or into a companion file sitting next to it with the same file name and a different extension. That data can include the exact file creation time, the camera model and firmware, and on GPS equipped cameras a track of coordinates and road speed sampled every second or so through the clip.

That second layer is often the part that ends an argument. A visible timestamp says when. A GPS track says where, how fast, and in which direction, second by second, across the approach to an intersection. If two accounts disagree about who had the green light, the speed trace either supports your version or it does not, and it does that without anyone's memory being involved.

Copy the folder, not the clip. Because some brands store the GPS log in a separate file that shares the video's file name, dragging out one MP4 and leaving the rest behind can throw away half the useful material. When you pull footage off a card, copy the entire folder structure, including any file with a matching name and an unfamiliar extension. Storage is not the constraint here.

While you are at it, check the camera clock. A dash cam that sat flat for a fortnight, or one whose internal supercapacitor has aged out, can lose its time setting and start stamping 1 January 2020 on everything. That is the sort of detail that gets a clip picked apart later, and it is a two minute fix in the settings menu before you need it rather than after. Handing the footage over without wrecking it

The principle is simple. Keep an original that nobody has touched. Give out copies. Never let your only version leave your hands.

In practice that means putting the card in a reader on a computer, copying the folder to a location you control, and then leaving that copy alone permanently. Do not trim it. Do not run it through an editor to cut out the boring three minutes before the incident. Do not convert it to a smaller format because the email bounced. Make a second working copy and mess with that one if you need to, but the master stays exactly as the camera wrote it.

Trimmed clips create a problem you do not need. The moment a video starts four seconds before impact, the obvious question is what happened in the minute before, and you are the person who removed it. An unedited original with two dull minutes of suburban road at the front is a stronger thing to hand over than a tight ten second cut, even though the ten second cut is the bit anyone will actually watch.

Do

  • Copy the whole folder off the card with a card reader
  • Keep one untouched master copy on a drive you control
  • Note the date, clock time, location and direction of travel
  • Provide the unedited original clip, plus a note pointing to the timecode
  • Retire the card and buy a new one if the matter is serious

Do not

  • Film the camera screen with your phone
  • Send footage through WhatsApp, Messenger or a social upload
  • Trim, crop, re-encode or add annotations to the master
  • Hand over your only copy and keep nothing
  • Put the card back in the camera and keep driving

If a matter looks serious, stop using that card entirely. Label it, put it somewhere sensible, and fit a fresh high endurance card to the camera. A replacement card costs less than a tank of fuel, and it removes any later question about whether the original was still intact. What insurers generally want, and why you have to ask yours

Dash cam footage is commonly used to support motor claims in Australia. Where it earns its keep is the not-at-fault claim: the rear end collision, the merge that never checked its mirror, the car park hit on a parked vehicle with nobody around. Those are the situations that otherwise come down to one account against another, and a clear clip with a readable plate does something no witness statement does.

What I am not going to do is promise you an outcome. Insurers assess claims on the policy you hold and the facts of the incident, and footage is one input among several. I have had customers whose claim turned on a clip and customers whose insurer barely looked at it.

The part that varies most is mechanics, and this is where people waste days. Accepted file formats differ. Maximum upload sizes differ. Some insurers use a claims portal, some want a link to a cloud folder, some will ask you to post a USB stick. Some will tell you what timecode to point them to and some want the whole clip. Ask your own insurer when you lodge the claim, before you spend an evening converting a 4K file to fit an attachment limit. The audio question is a state question, not a national one

A lot of dash cams record audio by default, and most owners have never opened the menu to check. The little microphone icon is on, the cabin conversation is on the file, and nobody in the car has thought about it once.

Recording of private conversations in Australia is governed by state and territory surveillance and listening device legislation. There is no single national rule, and the legislation is not the same across the country. Anyone who tells you "the law in Australia says X" about in-car audio is skipping over the fact that it depends which side of a border you are on.

For our customers on the Central Coast, the relevant legislation is the Surveillance Devices Act 2007 (NSW). The NSW Department of Communities and Justice publishes a plain overview of how that Act is structured and what it covers. I am a repair technician. I am not going to walk you through what any of it means for your circumstances, and you should be sceptical of any repair shop or forum post that tries.

What I can help with is the practical half, which is the half people actually get wrong:

  • Know where the audio toggle lives. On most cameras it is one or two levels into the settings menu, often labelled Record Audio, MIC or Voice Recording. Find it now, while the car is parked and nothing has happened.
  • Know whether it is currently on. Many cameras show a small microphone icon on the live view. Some cameras let you mute it with a single button press while driving, which is handy and also easy to knock by accident.
  • Tell your passengers. If audio is on, say so. It costs you one sentence and it removes the awkward version of this conversation entirely.
  • Check after a firmware update. Updates occasionally reset settings to factory defaults, and factory default on plenty of cameras is audio on.
  • If you are unsure about the legal side, go and find out properly. Read your own state or territory's legislation, ask your insurer, or get advice from someone qualified to give it.

Cabin facing cameras raise the same set of questions with a lens attached instead of a microphone, and rideshare and delivery drivers sit in a different situation again to a private driver. That is well past where a repair bench can be useful.

Publishing the clip is a separate decision with its own consequences

Crash footage does numbers online, and the temptation to post is real, especially when the other driver behaved badly and you have the proof. I would slow down before uploading.

Once a clip is public you have lost control of it. It gets downloaded, recut, reposted with a different caption, and dropped into compilation channels. If a number plate or a face is visible, so is the person attached to it, and the comment section will have opinions about someone who has not had a chance to say anything. Naming the other driver publicly takes it further again.

The practical caution is this: publishing can complicate a claim or a matter that is still open, and it can create problems that the footage on its own would never have caused. A clip sitting on your hard drive and handed to your insurer is doing its job. The same clip with forty thousand views is doing something else. If you want a view on whether posting is a good idea in your particular case, that is a question for your insurer or a lawyer, not for a comment thread.

The Office of the Australian Information Commissioner publishes general material on surveillance and monitoring, which is a sensible place to start reading if the privacy side is what you are weighing up.

Blurring is not undoing. If you do publish, blurring a plate in the uploaded version changes nothing about the original file, which is what you should still be keeping intact. Never edit the master to make a version fit for posting. Export a separate copy for that and leave the original alone.

When the card is corrupted, unreadable or the file is missing

This is the call I take most often, and it usually opens the same way: the crash is on the camera, but the file will not play, or the folder is empty, or the camera says the card needs formatting.

Corruption after an impact is normally a file system problem rather than destroyed video. The camera lost power part way through writing a clip, so the index that tells a computer where the file starts and stops never got finished. The video data is frequently still there in the raw sectors, unindexed and invisible to Windows, waiting for someone to carve it back out. Heat kills cards too, and no-name cards in a car that sits in the sun on The Entrance Road all summer fail at a rate that would surprise most people.

Whatever you do, stop writing to the card. Do not put it back in the camera. Do not accept Windows' offer to scan and fix the drive, and do not run a free recovery tool that wants to write its repairs back to the same card. Every write reduces what can be pulled off it. What goes wrong at the counter

Sixteen years on the bench produces a short list of things that repeat, and dash cam footage has a very predictable one.

The card that kept driving. Someone has an incident on Tuesday, remembers the camera on Friday, and by then the card has been through three days of commuting. Loop recording does not care about the calendar. This is the number one cause of lost dash cam evidence and it has nothing to do with the equipment.

The formatted card. The camera threw an error, the owner tapped the option that made the error go away, and that option was Format. Formatting does not usually erase the underlying data, so there is often still something to recover, but it makes the job considerably harder and less certain than it needed to be.

The two dollar card. Continuous video writing is brutal on flash memory. A standard phone card will do it for a while and then start dropping clips, corrupting files, or silently recording nothing while the camera happily shows a live preview. High endurance cards exist because this is a real failure mode, not a marketing tier.

The camera nobody ever checked. Play back one clip a month. Confirm it is recording, confirm the picture is clear enough to read a plate at a car length, and confirm the date stamp is right. Two minutes. I have had people discover their camera stopped writing eight months earlier, which they found out on the day they needed it.

The phone-video-of-the-screen. Covered above, still happening, still the easiest thing on this list to avoid.
